About these terms and conditions
You should read these terms and conditions carefully before using this web site (the 'Site'). By accessing and using the Site you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, you may not access or use the Site.
Site content
Euler Hermes Ireland is a branch of Euler Hermes UK Plc, a company registered in England and Wales, number 149786. Although Euler Hermes Ireland ('Euler Hermes Ireland'), has taken all reasonable care to ensure that the information posted on the Site is current, true and accurate in all material respects and that there are no other material facts the omission of which would make any of the information misleading, Euler Hermes Ireland gives no warranty, express or implied, with regard to the accuracy or currency of the information posted on the Site. The content of the Site is general in nature and for information purposes only.

Territory
The Site is directed at European Union residents only and the services described in the Site are only available to European Union residents to the extent that Euler Hermes Ireland is licensed to sell insurance within the European Union. You agree to use the Site in a manner consistent with any and all applicable law and regulation in the country in which you access the Site.
Scope of your responsibility
You are wholly responsible for the use of the Site by any person using your terminal or point of presence and are responsible for ensuring that any such person also fully complies with these terms and conditions.
Your breach
If you are in breach of these terms and conditions you agree to indemnify Euler Hermes Ireland in respect of any and all losses, costs or damages including reasonable legal fees incurred by Euler Hermes Ireland in relation to or arising out of such breach
Data protection
The Data Protection Act 1998 (the Act) Words shown in italic have the meaning given by The Data Protection Act 1998. Euler Hermes Ireland is registered under the Act to process personal data (data). Where Euler Hermes Ireland is provided with data, the data will be processed in accordance with the provisions of the Act for the purpose of carrying out credit insurance and associated activities, and the data will be held securely and kept confidential at all times.
Data relating to you the Data Subject will be processed by the Data Controllers and will be held securely in confidence and processed for the purpose of carrying out the business of the Data Controllers and associated activities such as insurance, risk assessment and other related activities (“Activities”). The Data Controller may consult with and disclose the Data Subject’s Data to third parties such as insurers, credit insurers, credit reference agencies and other carefully selected parties (“Third Parties”) who may process the Data also as Data Controllers for the purpose of carrying out the Activities for any business applications made directly or indirectly to the Data Controllers by the Data Subject now or in the future. The Data Controllers may also receive Data on the Data Subject from the Third Parties. The Data will be processed both within and outside the European Economic Area.
The Data Controllers may contact the Data Subject regarding details of other products and services in writing, electronically or by phone. If the Data Subject does not wish to receive such details please write to the Marketing Department at Marketing, Euler Hermes UK plc, 1 Canada Square, London E14 5DX.
To the extent that you are not the individual whose data are being processed, you confirm that you have obtained the consent of that individual to permit Euler Hermes Ireland to process the data as above.
Where you are processing the data on the Site for Euler Hermes Ireland, you will be a data processor and you must:
follow any instructions given by Euler Hermes Ireland in your processing; have in place, appropriate technical and organisational measures to safeguard Euler Hermes Ireland against any unauthorised or unlawful processing on the Site and appropriate measures to prevent accidental loss, destruction or damage to the data; and have an up-to-date notification entry filed with The Information Commissioner’s Office; and you agree to indemnify Euler Hermes Ireland for loss, damage and costs, directly or indirectly caused as a consequence of your contravention of the Act.
Privacy Statement
Euler Hermes Ireland recognises and appreciates the importance of responsible use of any personal information about you which may be collected on this site. Euler Hermes will not disclose your personal information to any third parties, except to other Euler Hermes group companies, when required.
Exclusions
Euler Hermes Ireland makes no warranties except as set out in these terms and conditions and to the extent permitted by law all other express and implied warranties are hereby excluded.
Limitation of Liability
To the extent permitted by law, Euler Hermes Ireland does not accept any responsibility for any losses or damages whatsoever including, without limitation, direct, indirect, special or consequential loss or damage and/or loss of profits, business revenue, goodwill or anticipated savings arising out of access to or use of or reliance on any information posted on the Site or any hypertext or hyperlink to a web site or any information contained on or accessed through such web site.
Entire Agreement
These terms and conditions contain the entire understanding between you and Euler Hermes Ireland with regard to your use of the Site and no representation, statement or inducement, whether oral or written, not contained herein shall bind either you or Euler Hermes Ireland. Euler Hermes Ireland reserves the right to change these terms and conditions from time to time. Use of the Site is subject to the terms and conditions posted on the Site at the time of your visit. If you do not agree to any changes to the terms and conditions then you must immediately stop using the Site.
No Insurance Contract
Please note that Euler Hermes Ireland does not sell insurance over the Internet. Any contract of insurance between you and Euler Hermes Ireland will be governed by separate terms and conditions agreed between you and Euler Hermes Ireland.
Severability
Should any part of these terms and conditions for any reason be declared invalid by a court of competent jurisdiction, such determination shall not affect the validity of any remaining portion and such remaining portion shall remain in full force and effect as if the invalid portion of these terms and conditions had been eliminated. |
